Πρωτοφανής απόφαση της ιταλικής δικαιοσύνης ανοίγει το δρόμο για λογοκρισία στο Internet

Μια πρόσφατη απόφαση ιταλικού δικαστηρίου έχει προκαλέσει θύελλα αντιδράσεων, καθώς δημιουργεί νομολογία που μπορεί να οδηγήσει σε επικίνδυνες ατραπούς. Η ιταλική δικαιοσύνη καταδίκασε πρόσφατα τρία στελέχη της Google σε φυλάκιση με αναστολή, κρίνοντάς τους ένοχους για ένα video που ανέβηκε πρόσφατα στο YouTube και το οποίο εμφάνιζε ένα περιστατικό βίας μεταξύ ανηλίκων.

Αν και οι κατηγορούμενοι δεν είχαν καμία απολύτως σχέση με το video, οι δικαστές δε δίστασαν να τους αποδώσουν την ποινική ευθύνη, με το σκεπτικό ότι άφησαν το video να δημοσιοποιηθεί στην υπηρεσία τους. Η ειρωνία είναι ότι η Google κατέβασε αμέσως το video μόλις ενημερώθηκε και βοήθησε τις ιταλικές αρχές να εντοπίσουν τους ανηλίκους που είχαν τη φυσική ευθύνη του περιστατικού, οι οποίοι τιμωρήθηκαν με απλή κοινοτική εργασία. Οι τρεις καταδικασθέντες, οι οποίοι δικάστηκαν ερήμην, αναμένεται να ασκήσουν έφεση.

Η απόφαση αυτή θα μπορούσε να αποτελέσει ένα πολύ κακό προηγούμενο, ανοίγοντας το δρόμο για φαινόμενα λογοκρισίας στο Internet. Ούτε λίγο, ούτε πολύ, οι Ιταλοί δικαστές θεωρούν ότι η Google θα πρέπει να ελέγχει τα videos -και κατ' επέκταση τις φωτογραφίες, τα κείμενα κλπ- πριν δημοσιοποιηθούν στις υπηρεσίες της και να επιλέγει ποια από αυτά θα κοινοποιηθούν. Αυτό, βέβαια, δε διαφέρει ιδιαίτερα από τις πρακτικές ενός απολυταρχικού καθεστώτος που φιμώνει την ελεύθερη έκφραση. Μπορεί η απόλυτη ελευθερία του Internet να έχει και τις αρνητικές της πλευρές, σε κάθε περίπτωση όμως είναι προτιμότερη από τη λογοκρισία του περιεχομένου.
