Δικαστική απόφαση επί της "διαδικτυακής ουδετερότητας"

Η Ομοσπονδιακή Επιτροπή Τηλεπικοινωνιών δεν έχει δικαιοδοσία να επιβάλλει την αρχή της ουδετερότητας στους παρόχους πρόσβασης, σύμφωνα με απόφαση αμερικανικού εφετείου. Η συγκεκριμένη δικαστική κρίση επιφέρει σοβαρό πλήγμα στο σχέδιο των ομοσπονδιακών αρχών να τερματίσουν τις διακρίσεις εις βάρος των χρηστών του Διαδικτύου που κατεβάζουν μεγάλους όγκους δεδομένων.

Ως "διαδικτυακή ουδετερότητα" ορίζεται η αρχή, σύμφωνα με την οποία οι πάροχοι πρόσβασης (ISP) οφείλουν να προσφέρουν τις ίδιες ταχύτητες πρόσβασης και το ίδιο επίπεδο υπηρεσιών σε όλους τους πελάτες τους, ανεξάρτητα από τη διαδικτυακή συμπεριφορά τους.

Η Ομοσπονδιακή Επιτροπή Τηλεπικοινωνιών εμφανίστηκε στο πρόσφατο παρελθόν αποφασισμένη να επιβάλει την αρχή της ουδετερότητας, με εντολή κατά μίας εκ των μεγαλυτέρων εταιρειών τηλεπικοινωνιών στις ΗΠΑ, η οποία εμπόδιζε το κατέβασμα αρχείων μέσω του συστήματος BitTorrent. Το Εφετείο της Περιφέρειας της Κολούμπια, ωστόσο, απεφάνθη ότι το Κογκρέσο δεν έχει δώσει δικαιοδοσία στην FCC να ρυθμίζει τις πρακτικές των εταιριών και παρόχων διαδικτυακών υπηρεσιών.

Η Επιτροπή, πάντως, σχολιάζοντας την απόφαση, άφησε να εννοηθεί ότι το θέμα δεν έχει κλείσει, τονίζοντας σε ανακοίνωσή της ότι η FCC παραμένει σθεναρά δεσμευμένη στην προώθηση ενός ανοιχτού Διαδικτύου και των πολιτικών που θα φέρουν τα τεράστια οφέλη της ευρυζωνικότητας σε όλους τους Αμερικανούς.
