Δικαίωση εταιρείας σε υπόθεση file sharing

Τελευταία  οι νομικές κινήσεις εναντίον εταιρειών παροχής διαδικτυακών υπηρεσιών, ιδιοκτητών ιστοσελίδων αλλά και απλών χριστών έχουν ενταθεί σε μια ευρύτερη προσπάθεια για τη καταπολέμηση της πειρατείας.
Ενώ ένα τέτοιο κλίμα διαμορφώνεται στην Αυστραλία δικαστήριο δικαίωσε τον πάροχο υπηρεσιών διαδικτύου iiNet. Η εταιρεία είχε κατηγορηθεί από τις εταιρείες παραγωγής κινηματογραφικών ταινιών οτι δεν είχε λάβει τα απαραίτητα μέτρα για να εμποδίσει τους χρήστες απο το να έχουν πρόσβαση σε κινηματογραφικές ταινίες κατά παράβαση των διατάξεων περί πνευματικής ιδιοκτησίας.
Το δικαστήριο δέχτηκε το επιχείρημα της iiNet  σύμφωνα με το οποίο ο πάροχος δεν οφείλει να ελέγχει το διακινούμενο υλικό ή να κοινοποιεί προσωπικά δεδομένα πελατών του σε τρίτες εταιρείες, που θεωρούν πως θίγονται τα συμφέροντά τους. Κάτι τέτοιο θα αποτελούσε παραβίαση της ιδιωτικής ζωής των χρηστών.
Η απόφαση αυτή του δικαστηρίου ίσως δημιουργήσει νομικό προηγούμενο και για άλλες χώρες.
